Why identifying the governing law comes first
In decision 16288/Personal Status and Personal Matters Panel/2026, dated 16 August 2026, the Federal Court of Cassation instructed a trial court to rely on the Code where the application of Jaafari rules had been selected, rather than cite provisions of Personal Status Law No. 188 of 1959. The dispute concerned custody, but its practical lesson is wider: an acceptable outcome does not remove the need to identify its proper legal basis. This is a published judicial decision, not a new legislative amendment. [1]
This article explains the federal framework for Muslim personal status matters, as verified up to 24 October 2026. It does not decide any particular family's case or assume automatic application to the Kurdistan Region, non-Muslims, or relationships involving foreign elements. Such situations may require additional jurisdictional, conflict-of-laws and regional rules.
Three dates that must remain distinct
The President issued Law No. 1 of 2025 on 11 February 2025. It was published in Iraqi Gazette issue 4814 on 17 February 2025 and entered into force that day under Article 2. The Code was approved by Decision No. 10, dated 30 September 2025, then published in issue 4843 on 6 October 2025. The decision provides that both it and the Code take effect upon publication. A ministry's announcement date is not the commencement date; nor were all Code provisions published legislation as early as February. [2][3]
Between the amendment's commencement and the Code's publication, the law provided for courts to refer questions concerning covered persons to the Scientific Council of the Shia Endowment Office. Following publication, Article 335 regulates referral where the Code contains no provision. The dates of the event, claim, selection and judgment consequently matter. Neither “the new law is retrospective” nor “an old marriage is entirely unaffected” resolves the issue. [2][3]
When is there a legally relevant selection?
The amendment added paragraph 3 to Article 2 of Law 188. For new marriages, subparagraph (a) allows an Iraqi Muslim man and Iraqi Muslim woman, when concluding and registering their marriage in the Personal Status Court, to select Jaafari rules for themselves and their minor children in all personal status matters. It also provides that they may not later change that selection. This has continuing consequences; it is not an opportunity to choose an individual rule afresh in each case. [2]
For marriages concluded and registered before the amendment commenced, the text permits either legally competent party to apply to court if the marriage was concluded according to that school. It identifies deferred dower payable upon demand and financial ability as evidence of that fact. Nevertheless, an isolated dower phrase, detached from the contract, judicial instrument and proceedings, does not establish that a particular person is necessarily covered. The court examines the statutory conditions, documents and application. [2]
Subparagraph (b) also addresses an application by a fully competent Iraqi Muslim man or woman outside the preceding categories to have Jaafari personal status rules applied to that person. This is another reason not to reduce the entire amendment to the date of marriage.
Must the other spouse agree in an earlier marriage?
The General Assembly of the Federal Court of Cassation addressed an important point in decision 17/General Assembly/2025, dated 27 October 2025. A unilateral selection satisfying the amendment's conditions extends to both spouses and their minor children even without the other spouse's agreement, whether the marriage continues or has ended. This is the court's interpretation of the statutory conditions for earlier marriages; a personal announcement online does not replace a court application. [4]
Where parties in one case make conflicting selections, subparagraph (h) contains a specific rule: the selection of the divorcing person, testator or deceased is followed respectively in the pronouncement of divorce, implementation of a will and distribution of inheritance. In other matters, the majority selection of legally competent parties is followed; without a majority, the court chooses what is closest to justice and equity. This provision must be read alongside an established binding selection, rather than treated as a fresh vote that automatically cancels it. [2]
What are the temporal limits?
Decision 14977/2025, dated 28 October 2025, stresses that the amendment operates from publication and must not be applied to earlier events contrary to temporal application rules. The published page provides insufficient factual detail to turn this ruling into a blanket prohibition on selections relating to older marriages: the statute expressly permits such applications. An older marriage contract, a completed event, a new application and a final judgment are different questions. [5]
Nor should readers assume that every earlier judgment can immediately be reopened following a selection application. Appeal procedures, the binding effect of judgments and established rights require separate examination under the applicable procedural law and the facts of the file.
A fictional example and a document-reading method
“Hassan” and “Layla” married in 2018. Their contract contains deferred dower payable upon demand and financial ability. In 2026, one applies to select Jaafari rules. This example is entirely fictional. Analysis should begin with the registered contract, the applicant's capacity, the selection instrument and its date, the nature of the dispute and any earlier judgments. It should not begin by assuming that rights have disappeared or custody has transferred. Only then can the appropriate substantive provision within the governing system be examined.
A useful chronological file contains the marriage contract and appendices, any selection instrument, earlier decisions, and evidence of service and finality. This helps readers understand the legal history. It is not a complete filing checklist or a guarantee that a claim will be admitted.
The Kurdistan Region and common mistakes
The Region has Law No. 15 of 2008 amending the application of Law 188, available in the Kurdistan Parliament's legislation database. The competent court and legislation in force there must therefore be checked separately. A federal explanation cannot simply be transferred to the Region because the claim has a similar name. [6]
Common mistakes include assuming that Law 188 has been repealed for everyone, equating a verbally declared affiliation with a judicial selection, or combining rules from the two systems to obtain a preferred result. Likewise, the mechanism for matters omitted from the Code does not authorize reliance on any religious opinion or online post: the law and Code designate the referral body and mechanism. [2][3]
Frequently asked questions
Does a marriage before 2025 prevent application of the Code? No. The amendment allows applications concerning earlier marriages subject to conditions, and the court has interpreted the effect of one party's selection. [2][4]
Is it enough that both parties follow the same school? Religious affiliation alone does not safely identify the governing system. The contract, selection and judicial records must be checked.
Did the Code take effect when approved or announced? The approval decision ties commencement to publication. Issue 4843 bears the date 6 October 2025. [3]
This is general legal education. Outcomes depend on the documents, dates and competent court. The official Arabic text prevails over this explanatory translation.
