Child Custody and Contact in Iraq: Understanding the 2026 Decisions

Distinguishing Law 188 from the Jaafari Code, the age-seven rule, maturity and choice, and evidence of the child’s interests.

What did the July 2026 custody decision add?

On 21 July 2026, the Expanded Civil Panel of the Federal Court of Cassation upheld an order placing two children in their father's custody in a case governed by the Jaafari Code. Decision 176 linked the transfer after age seven to Article 81, while requiring the father's fitness and absence of disqualifying circumstances to be established. It referred to psychological and social inquiries and inspection of the home. Reading only “after seven” omits an essential part of the judgment: judicial examination of fitness and caregiving conditions. [1]

The decision does not make seven the custody threshold for every family in Iraq. Nor does the phrase “the child's best interests” permit the governing statutory provisions to be ignored. A careful analysis identifies the applicable regime, reads its rules, and presents facts the court can examine. The practical purpose is to organise care and stability for the child, rather than frame the case as one parent's personal victory.

Begin with the marriage contract and choice documents

After Law 1 of 2025, custody cannot be addressed without examining the basis for applying the Code. There are rules for choosing the regime when the contract is concluded and registered, and a route for earlier contracts subject to statutory conditions. Review the contract together with choice applications, instruments and earlier judgments. Neither the child's birth date nor one parent's preference alone should be assumed to identify the applicable rule. [2]

This article addresses the federal framework. Kurdistan Region cases and international conflicts require separate examination. Where an earlier custody judgment exists, review its operative provisions, date, procedural position and later developments. A family should not be told that its order “ended by itself” merely because a legal amendment was reported.

Law 188: custody cannot be reduced to age fifteen

In its 2019 account of the Personal Status Law, the Supreme Judicial Council explained that Article 57 sets the custody age at ten, with further questions of transfer or continuation requiring consideration of the parents' circumstances and harm to the child. Another official judicial source explains extension up to fifteen where the child's interests justify it, followed by choice under the statutory conditions. These are distinct stages, not automatic continuation to fifteen in every case. [4][5]

Decision 10095 of 2025 also distinguished an application confirming custody from the position of a child who had passed fifteen and entered the choice stage under Article 57(5). That rule should not be transplanted into a Code-governed case, nor presented as an unconditional freedom beyond the requirements of the provision and the court. [6]

The Code: seven, maturity and contact

The official text of Article 81 sets out the custody sequence until seven and then with the father until custody ends. Article 82 addresses opportunities for the other parent to meet and communicate with the child and judicial determination where there is disagreement. This explanation uses the adopted text in the Iraqi Official Gazette, rather than a draft circulated before approval. [3]

Ending custody and exercising choice also require attention to another decision. On 31 March 2026, the Expanded Civil Panel in Decision 93 interpreted maturity for Article 88 purposes as completion of eighteen years, relying on Article 106 of the Civil Code. Commonly discussed religious puberty ages therefore should not be presented as, by themselves, the age for choosing residence under this judicial application. Distinguish the Code's text from the court's interpretation and check for later developments. [7]

Present the child's interests through verifiable facts

Best interests are not a phrase added at the end of a pleading instead of evidence. Practical preparation can address who provides daily care, schooling and treatment, the suitability of accommodation, care arrangements during working hours and specific safety concerns. These are preparatory questions. No single item necessarily decides the case, and the checklist does not create additional statutory conditions.

In Decision 10039 of 17 May 2026, applying the Code, the Court explained that a continuing marriage does not prevent a custody claim. It required investigation of fitness, including examination by the competent medical committee. Custody may therefore arise before divorce, and the court's inquiry concerns care rather than merely the marital status written on an application. [8]

Hypothetical example: an eight-year-old and two different files

Two parents disagree about where their eight-year-old should live. In the first file, no basis for applying the Code has been established. In the second, judicial documents concern a choice of that regime. The comparison should begin by identifying the applicable rules in each file, rather than asking “who wins?” Evidence of care and fitness can then be examined, while the custody application is distinguished from arrangements for visits and contact. The example awards neither parent an outcome. It explains why one family's answer may not fit another even where the children are the same age.

Preparing documents while protecting the child

  • The marriage contract, birth records and documents concerning the choice of legal regime.

  • Copies of earlier orders, handover and visitation records, and notices where applicable.

  • Lawfully obtained information about school, medical treatment, daily care and accommodation.

  • A chronology of disputed events, separating directly observed facts from assumptions or hearsay.

Preserve originals and provide them through the proper channels. Do not publish the child's medical reports or photographs from the dispute, and do not coach the child to give answers serving either parent. A proposed contact arrangement can address school, treatment, distance, times and location, and then be checked against the order and governing regime. An organised proposal is more useful than an undefined request.

Frequently asked questions

Does one parent's custody cancel the other parent's contact? Article 82 of the Code regulates meetings and communication, with judicial determination on disagreement according to its terms. Cancellation should not be inferred from custody alone. [3]

Do fifteen and eighteen form one rule for everyone? No. Article 57(5) of Law 188 must be distinguished from Article 88 of the Code as applied in Decision 93 of 2026. [6][7]

Does one psychological report guarantee a ruling? It should never be presented as a guarantee. The recent decision described a combination of inquiries and evidence; their assessment depends on the case and the applicable provisions. [1]
