The phrase “I want a divorce” may conceal two different requests: a person alleges that a divorce already occurred outside court and wants it established, or a person seeks judicial termination of the marriage. Confusing these routes can obscure the facts, remedy and associated rights. On 30 March 2026 the Supreme Judicial Council published a report on khulʿ distinguishing confirmation of a valid earlier event from a request for a new khulʿ where agreement had not been reached. The report conveys judges' explanations; it is not a single judgment covering every divorce file. [1]
Three questions before choosing a route
First, is a specific past event alleged, or has nothing occurred and a court order ending the marriage is sought? Second, which substantive legal framework governs the parties? Third, which documents, dates and associated claims matter? A party's chosen label is not decisive. The court examines the actual facts and legal basis under the relevant procedure and legislation.
Within Personal Status Law No. 188 of 1959, Article 39 addresses bringing a court action to pronounce divorce and obtain judgment, and recording it during the waiting period where attending court was not possible; it also maintains the marriage instrument's standing until the court invalidates it. A non-judicial paper or oral understanding should therefore not be treated as sufficient to determine the registered position or all its consequences. Delay in recording must not be addressed by inventing a different date. The actual event should be presented for lawful treatment. [2]
Applicable law after 2025
Law No. 1 of 2025 was published in Official Gazette Issue 4814 on 17 February 2025. It added mechanisms for choosing Jaafari rules to Article 2 of Law No. 188. The annexed Code was then published under Decision No. 10 of 2025 in Issue 4843 on 6 October 2025, with the decision providing for commencement on publication. This is different from saying Law No. 188 was wholly repealed or that every Iraqi marriage automatically became subject to the Code. [3][4]
Examine the marriage contract, the dates of conclusion and registration, and any court application or ruling concerning the applicable choice. Names or residence do not establish the governing framework. Article 2(3) also contains provisions addressing divergent choices, so it is inaccurate to assume that agreement by both spouses is required in every circumstance. Identifying the framework comes before applying its divorce or separation conditions and does not replace examination of the individual family's circumstances. [2]
Confirmation examines an event, not merely a paper
An action to confirm a divorce involves examining occurrence, conditions, date and classification, as well as any relevant earlier divorce or resumption of marriage. In Decision 8238/Divorce Confirmation/2012 of 5 November 2012, the Federal Court of Cassation overturned a judgment because the lower court had not completed its examination of the parties' admission of an earlier divorce and subsequent resumption. This historical judicial example illustrates why the sequence matters; it is not new reporting or a prediction for another case. [5]
Useful preparation includes preserving the marriage instrument, earlier judgments or certificates, any document recording the alleged event and details of people with direct knowledge. Do not alter documents or coach witnesses. This is a suggested preparation list, not an exhaustive official set of required attachments; the court may require further material according to the proceedings. Confirmation cannot properly be used to turn an invalid event into a valid divorce through a later agreement to present an invented account.
Judicial separation is a different inquiry
Where judicial dissolution is sought, its grounds, conditions and proof depend on the applicable law. A recent illustration is Decision 3385/Personal Status Panel/2026 of 22 February 2026, addressing the absence of separation merely for disagreement under the Code and considering its relevant provisions. It demonstrates the danger of importing a route under Law No. 188, such as Article 41, into a Code-governed file without distinction. That does not mean no judicial route exists; it means each requested remedy needs its proper legal basis. [6]
The Code includes specific provisions, including Articles 70–72, concerning circumstances distinct from simply describing a relationship as conflicted. Record the particular conduct or failure said to justify the request, then examine the governing conditions rather than relying only on the statement that “life together is impossible”. This explains a method of legal reading; it does not establish a ground in an individual's case or recommend a particular action. [4]
Why consent differs in khulʿ cases
The report of 30 March 2026 explained the difference between seeking a new khulʿ in court and confirming one that already validly occurred. A husband's current refusal does not by itself erase an earlier event whose conditions are established. Conversely, a new khulʿ should not be assumed to exist simply because one party desires it and uses that label. The consideration offered and its limits need careful examination. Ending a marriage should not be assumed automatically to extinguish all financial entitlements or children's rights. [1]
Fictional example
Two spouses say they ended the relationship outside court months earlier, but now disagree about the date and whether their agreement included deferred dower. The original document, correspondence chronology and earlier judgments are preserved. The validity of the divorce is considered separately from the scope of any financial relinquishment. A phrase such as “everything is finished” does not alone establish a waiver, and this example does not determine the event's validity. It is invented for educational purposes and describes no real file.
Common mistakes and three questions
Do not confuse the alleged event's date with filing, judgment or civil-record update dates.
Do not assume dower, maintenance and custody all disappear upon pronouncement; each issue has its own conditions and claims.
Do not sign an unexplained general waiver or publish family details to win a public argument.
Do not copy a procedure from an older case without checking the currently applicable framework.
Does a cleric's paper replace court proceedings? It should not be treated as an automatic substitute for judgment, judicial procedure or updating official records. It may form part of the material examined, without deciding every condition or consequence by itself.
Is every out-of-court divorce invalid? That cannot safely be generalised. The court examines facts and conditions under the applicable framework. Equally, it cannot be assumed that every paper or message creates a valid divorce.
Does applying the Code restart every earlier case? That does not follow from the amendment's title. The proceedings' dates, decisions and their established effects, the judicial choice and applicable provisions require examination. No reopening or changed outcome is promised.
This is general educational material based on sources checked through 24 October 2026, focused on federal Iraq. The Kurdistan Region has relevant legislation and amendments not examined in detail here. This article does not calculate a waiting period or determine an individual's marital status or entitlements. Official legislation and the competent courts' decisions remain the basis for assessment.
