When a court issues a decision, the immediate question is often: “How many days do I have to challenge it?” The proper answer begins earlier: what is the decision, and which route does the law permit? In Decision 158/Expanded Civil Panel/2026 of 13 July 2026, the Federal Court of Cassation reaffirmed that preparatory decisions which do not conclude proceedings generally cannot be challenged separately, subject to statutory exceptions permitting an independent cassation challenge. The first problem may therefore concern the available route or timing, before the number of days is calculated. [1]
Understand the document before counting days
Read the court's name and capacity, the type of proceedings, the operative order and its date. Is it a judgment disposing of the claim or a decision made during proceedings? Is the judgment classified in the file as adversarial or by default? A label added by a party to a circulating copy is insufficient. Objection to a default judgment, appeal, cassation, retrial and third-party objection differ in grounds, conditions and competent authority. Their names are not interchangeable.
The Civil Procedure Law supplies the general framework, and the distinction between judgments and interlocutory decisions is illustrated by Article 170. Identifying the available route in an individual case requires the full decision, any applicable special legislation and the procedural stage. This article deliberately provides no universal table of days: compressing different procedures into one number may cause a right to be lost instead of protected. [2]
Service is a legal procedure
Service allows a party to know about an action and prepare a defence, and important time limits and consequences depend on it. In judicial commentary published on 27 May 2025, Judge Imad Abdullah explained the connection between service and an opportunity to meet the opposing case, including the importance of prescribed form and particulars. This is commentary published by the judiciary, not a new judgment displacing legislation or validating every similar document. [3]
A useful practical approach is to preserve the notification, any envelope, the judgment and any record relating to receipt. Record when and where it was received and the recipient's capacity, distinguishing first-hand knowledge from information supplied by someone else. These are preservation suggestions, not findings that service is valid or invalid. A message from an opponent should not be assumed to replace court service; equally, the absence of personal hand delivery does not invariably prevent legally effective service.
The order of objections can matter
Decision 2775/Appellate Movables Panel/2026 of 9 June 2026 illustrates the danger of addressing the merits before a service objection. The Court of Cassation examined an objection which first denied the underlying debt and then alleged invalid service. Applying Article 73, which requires the relevant objection before another defence or request, it upheld the procedural rejection of the objection as out of time in that case's circumstances. [4]
That does not mean every service defect disappears following a message or telephone call, nor does it allow a reader to conclude that a judgment against them is final. The narrower lesson is that certain procedural objections have a legally prescribed order and timing. Examine the service file and proposed response before filing a submission on the underlying debt or obligation. Adding a general allegation of invalidity at the end should not be assumed sufficient.
Deadline, route and particulars are separate tests
The law makes challenge periods mandatory and attaches consequences to missing them. Judicial commentary published on 24 August 2020 discussed Article 171's general rule in a study arising from exceptional circumstances at that time. The relevant point here is the general rule, not an assumption that the temporary suspension measures discussed in 2020 remain effective. Any present suspension or exception needs its own current legal basis. [5]
Even a timely challenge must satisfy its required particulars. In Decision 7863/Appellate Real Property Panel/2025 of 19 November 2025, the Court of Cassation rejected a petition that omitted essential information required by Article 205(2), including party particulars. Merely identifying the judgment's number, date and issuing court did not cure the omission considered in that decision. A brief statement saying “I object to the decision” cannot therefore substitute for examining the petition's requirements. [6]
Fictional example
A person receives a copy of a money judgment from a relative, while the opponent says service took place earlier. The person preserves the copy and message, then seeks the full judgment and service records to identify the judgment's procedural classification and available challenge. The person does not rely only on the date the copy arrived or assume that the period is identical to one mentioned in a friend's case. The record may reveal valid service or a defect. This invented example predicts neither outcome and describes no real case.
Organising the file and avoiding mistakes
Gather the complete judgment, service records, authority to represent and relevant earlier decisions, numbering the copies.
Record issue, service and subsequent procedural dates separately rather than treating them as the same event.
Identify the route, competent authority, admissibility requirements and grounds before fixing the final filing date.
Preserve evidence of filing and completion of legally required payments or formalities, and monitor subsequent decisions.
Common mistakes include waiting for every secondary document before examining time limits, relying on an informal calculation, assuming negotiations automatically extend time or simply resubmitting a rejected request without understanding the rejection. Filing a challenge should also not be assumed automatically to suspend enforcement. Its effect on enforcement is a separate question governed by the relevant provision, procedure and, where required, judicial order.
Three frequently asked questions
Does every period run from the date judgment is issued? That cannot safely be generalised. Identify the applicable provision, the legally relevant starting event and the service record or legal equivalent, including any special rules or exceptions.
Can every decision be challenged immediately? Not as a general rule. Article 170 and the decision discussed above distinguish preparatory decisions from a final disposition and from decisions that legislation permits to be challenged independently. [1]
Will the court always correct a wrongly named challenge? Do not act on that assumption. Examine the substance of the request, the route's conditions, jurisdiction and time limit before filing. This article offers no assurance that an error will be cured.
This is educational material about federal Iraqi civil procedure, based on sources checked through 24 October 2026. It cannot calculate the final day in an individual case and should not be generalised to criminal or administrative proceedings or to the Kurdistan Region's procedures and amendments. The official decision, service file and any special governing provision are essential to an individual assessment.
